Law defines homicide as the killing of one human being by
another human being. Homicide always involves the death of a human being. This
is a very broad term and can be broken down into sub categories; criminal homicide
and justifiable or excusable homicide. Criminal homicide can be further broken
down into two groupings, murder and manslaughter; murder being intentional or
planed and manslaughter being accidental or involuntary. The act of murder has
a verity of sentencing’s; taking into consideration the motives, situation, background,
sanity, and age of the perpetrator.
Currently 38 states, including North Carolina, have fetal homicide
laws that concern violent acts against pregnant woman, covering situations both
fatal and non-fatal to the mother. In states with fetal homicide laws, the act
of murder against a fetus is the same as the act of murder against any born human
being; and the sentencing just a severe. The only case in which criminal murder is
legal is when it is done in a clinical setting by virtual cremation. How can we justify that? How is abortion a
legal “choice”?
This is happening now.
Read more! If you think it should be legal then tell my how? Why? Some more insight.
I think that US legislation should not prohibit abortion because it's a matter of personal choice. Every woman has a right to decide when to have a baby because she will carry the fetus inside her for nine months; it will remain a part of her during this time. A woman will give labor in pain, maybe it will last for hours; and later on she may have some health consequences. Besides, a woman will acquire a huge responsibility of upbringing and taking care of a child for the next 18 years. No government should enforce the laws, making abortion illegal practice. Nobody can make decisions, regarding a woman's health and well being. Sometimes abortion may even protect a physical health of a female. In the article from your link I have found such outrageous phrases as: "...women (and men) will always seek to get rid of their unborn children," "The unjust, intentional putting to death of a single, small, growing human being through abortion is the death of us all." I cannot agree with them. What about teenage pregnancy? Sometimes teens know nothing or very little about contraception or simply act recklessly. Young women may not appear ready to carry the burden. Once you have a baby, there is no way back- it will remain your long-term responsibility. What about raped women? Will the government force the victim to keep a child, whose face will remind her about the rapist and past traumatic experience every day? What if no prospects for marriage exist? It may turn out financially hard to take care of a child. In my opinion, a woman should never refuse education, career opportunity or just personal freedom because of one mistake. Moreover, the mother should want the child and feel ready for it. Only then the kid will grow up in the atmosphere of love and have a decent life.
